In a major setback for US President Donald Trump, the US Supreme Court on Tuesday struck down the executive order limiting birthright citizenship and reaffirmed the long-held principle that the Constitution guaranteed citizenship to nearly all children born on US soil.

According to Reuters, the 6-3 ruling marks the second time in 2026 when the court invalidated a major Trump initiative. This comes months after it strike down his sweeping global tariffs.

The Supreme Court has upheld the lower court’s decision, which earlier blocked the Trump administration’s order directing agencies not to recognise the citizenship of children born in the country if neither parent is an American citizen or legal permanent resident – a “green card” holder.

This comes after several challenged the order and argued that it violated language in the US Constitution’s 14th Amendment conferring citizenship those born in the country who are “subject to the jurisdiction thereof.”

Conservative Chief Justice John Roberts stated that Trump’s directive violates language in the 14th Amendment, which guarantees citizenship to virtually anyone born in the US, with a few narrow exceptions.

“Citizenship, then and now, was the right to have rights – to freely participate in our political community,” the court stated and added that the authors of the 14th Amendment extended that promise to every free-born person in the land, as per Reuters.

“We keep that promise today,” Roberts noted.

The order was issued by Trump last year on the first day back in office as part of his administration’s major crackdown on legal and illegal immigration.

Reacting to the Tuesday’s ruling, Trump wrote on his Truth Social platform, “The Supreme Court upheld Birthright Citizenship, which is too bad for our Country, but we can easily make it up in Congress through Legislation, with the support of the President, that has now been determined during this process.”

He added, “No long and unwieldy Constitutional Amendment is necessary! Congress should start TODAY to work on ending expensive and unfair to our Country, Birthright Citizenship. They will have my Complete and Total Support!”
